1. Information on how to enter and details of the prizes form part of these Terms and Conditions (“Conditions”). Entry into the ‘IGA Fresh May Apple Promotion’ (“Promotion”) is deemed to be an acceptance of these Conditions.
2. Promotion is open to residents of Australia. Employees of the Promoter (and their immediate families), the Promoter’s associated companies and participating IGA retailers (and their employees) and the Promoter’s agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Promotion commences 12.01am AEST on 10.05.10 and closes at 11.59pm AEST on 06.06.10 (“Promotion Period”).
How to enter
5. To be eligible to enter, individuals must, during the Promotion Period, purchase either a 1kg Field Fresh Punnet of Apples or minimum 1kg Loose Apples from a participating IGA, Supa IGA Supermarket or Foodland (SA) supermarket.
6. To enter, individuals must then log on to the website www.iga.net.au, follow the links to the promotional page and fully complete the online entry form including their first name, last name, telephone number, email address, street address, suburb, state, postcode, store of purchase, time of purchase and date of purchase (as featured on their qualifying purchase receipt) and submit the fully completed entry form during the promotional period.
YOU MUST RETAIN YOUR STORE RECEIPT SHOWING THE QUALIFYING PURCHASE, CORRESPONDING STORE NAME AND DATE AND TIME OF PURCHASE TO CLAIM YOUR PRIZE.
7. Incomplete, illegible or indecipherable entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised store names will be deemed invalid and; (d) limit of three (3) entries per person per day.
9. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
10. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will be void.
11. In order to claim a prize, entrants must retain their original or a photocopy of the IGA or Supa IGA or Foodland (SA) purchase receipt(s) as proof of making a valid purchase during the Promotion Period for all entries, including non-winning entries. Failure to provide the proof of purchase when requested may, in the absolute discretion of the Promoter, render all an entrant’s entries invalid and forfeit their right to any prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotion Period but prior to entry.
Prizes
12. The Prizes consist of:
1) Weekday Prize: 8GB Apple iPod touch (MC086ZP/A) valued at $268RRP each (incl. GST). Twenty (20) to be won. Total weekday prize pool valued at $5,360.
2) Weekly Prize: 64GB Apple iPad (Wi-Fi + 3G) estimated valued at $920. Four (4) to be won. Estimated total weekly prize pool valued at $3,680.
Total Prize pool value is $9,040.
How winners are determined
13. There will be a total of 20 Weekday Prize Draws which will be conducted between Monday to Friday for 4 weeks of the Promotion Period as follows:
a) The first Weekday Prize Draw will take place on Tuesday 11.05.10.
b) The final Weekday Prize Draw will take place on Monday 07.06.10
14. Entries for each Weekday Prize Draw will close at 11.59pm AEST on the preceding day. Entries received on Friday, Saturday and Sunday will be placed in a draw to take place on the following Monday. Each Weekday Prize Draw will be conducted at 12pm AEST at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne VIC 3207. The first valid entry randomly drawn in each Weekday Prize Draw will, subject to proof of purchase, each win a Weekday Prize.
15. Undrawn entries in each Weekday Prize Draw will be entered into any subsequent Weekday Prize Draws and all entries (including winners in Weekday Prize Draws) will be entered into the Weekly Prize Draws.
16. There will be four (4) Weekly Prize Draws to be conducted at 12pm AEST at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne VIC 3207 on 17.05.10, 24.05.10, 31.05.10 and 07.06.10. Entries for the Weekly Prize draws will close at 11.59pm AEST on the day prior to that draw. Entries received by 11.59pm AEST the day before each Weekly Prize Draw will be entered into that Weekly Prize Draw. Final entries close 11:59pm AEST on 06.06.10. The first valid entry randomly drawn in each Weekly Prize Draw will each win a Weekly Prize.
17. Un-drawn entries in each Weekly Prize Draw will be entered into any subsequent Weekly Prize Draws.
Notification of winners
18. All provisional winners will be notified by mail and where possible by telephone within two (2) days of the relevant draw.
19. All provisional winners will be required to send the Promoter a photocopy or original of their eligible IGA, Supa IGA or Foodland (SA) purchase receipt(s) to a reply paid address for verification purposes to claim their prize. Failure to provide the proof of purchase as set out for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of that entrant’s entries.
20. The names of all prize winners will be published in The Australian on 09.06.10. Winners will also be published on the Promoter’s website, at www.iga.net.au.
Unclaimed Prize Draw
21. The Promoter may conduct an unclaimed prize draw at 12pm AEST on 08.09.10 at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne 3207 as is necessary for any unclaimed prize, subject to any directions from a regulatory authority. Without limiting the requirement for compliance with these Conditions, all valid entries received during the Promotion Period will be eligible to win any unclaimed prize. The first valid entry drawn for each unclaimed prize will win that prize.
22. All winners of the unclaimed prize draw, if any, will be notified by mail and where possible by telephone within two (2) days of the draw.
23. The winner/s, if any, of any prizes awarded in the unclaimed prize draw will be published in The Australian on 08.10.10. Winners will also be published on the Promoter’s website, at www.iga.net.au.
General Conditions
24. Prizes will be delivered only in Australia via mail or courier. Please allow 28 days for delivery of all prizes after prize claim requirements outlined in clause 10 have been met.
25. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions from a regulatory authority.
26. Prize values are based on the recommended retail prices at the time of printing (including GST). The Promoter accepts no responsibility for changes in prize value between now and the ultimate prize redemption rate.
27. Prizes are not transferable or exchangeable and cannot be taken as cash. Promoter accepts no responsibility for any variation in the prize value.
28. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
29. The Promoter’s decision is final and no correspondence will be entered into.
30. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
33. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; and any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in relation to the Promotion, including, but not limited to, where arising out of or in relation to the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim or other form of communication to the Promoter that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions; (e) any tax liability incurred by an entrant; or (f) use of any prize.
34. The entrant’s details will be held in accordance with the IGA Privacy Policy which can be accessed by visiting http://www.iga.net.au/igafresh/index.cfm?page_id=2335 or calling (02) 9741 3000. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for the purpose of marketing activities such as direct marketing, generally to promote its products and services, and for its internal administrative, planning, product development and research needs. You may choose not to receive any communications from the Promoter at any time. Entrants should direct any request to access, update or correct information to the Promoter. All entries will become property of the Promoter. Each entrant’s submitted entries will remain anonymous and will be stored by the Promoter for further research purposes.
35. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
36. As a condition of accepting the prize, the winner may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
