CONDITIONS
1. Information on how to enter and details of the prizes form part of these Terms and Conditions ("Conditions"). Entry into the ‘IGA Fresh Potato Promotion’ ("Promotion") is deemed to be an acceptance of these Conditions.

2. Promotion is open to residents of Australia. Employees of the Promoter (and their immediate families), the Promoter’s associated companies, participating IGA retailers and the Promoter’s agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Promotion commences 12.01am AEDST on 11.01.10 and closes at 11.59pm AEDST on 07.02.10 ("Promotion Period").

How to enter

5. To be eligible to enter, individuals must purchase 1kg of loose or pre-packed potatoes from a participating IGA, Supa IGA or Foodland (SA) supermarket during the Promotion Period.

6. To enter, eligible entrants must then log on to the website www.iga.net.au, follow the links to the promotional page and fully complete the online entry form including their first name, last name, telephone number, email address, street address, suburb, state, postcode, IGA or Foodland store of purchase, time of purchase and date of purchase (as featured on their qualifying purchase receipt) and submit the fully completed entry form during the Promotion Period.

7. Incomplete, illegible or indecipherable entries will be deemed invalid.

8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised store names will be deemed invalid and; (d) limit of three (3) entries per person, per day.

9. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will be void.

10. In order to claim a prize, entrants must retain their original or a photocopy of the IGA, Supa IGA or Foodland purchase receipt(s) as proof of making a valid purchase during the Promotion Period for all entries, including non-winning entries. Failure to provide the proof of purchase when requested may, in the absolute discretion of the Promoter, render all an entrant’s entries invalid and forfeit their right to any of the prizes. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotion Period but prior to entry.

Prizes

11. The Prizes consist of:

a) Weekday Prize: Penguin cook book sets valued at $79.90 each (20 sets available to be won in total during the Promotion Period). Each set consists of the following books: Potatoes in 60 Ways: Great recipe Ideas with a Classic Ingredient and The Great Aussie Barbie Cookbook and Salad Bible. Total daily prize pool valued at $1,598.

b) Weekly Prize: Matson 45L portable fridge freezer MAF45 (dimensions: width 400mm x height 430mm x length 650mm) valued at up to $850. The fridge includes an insulation bag valued at $120, cigarette plug of 12 volts, a 240 volt power adaptor and a plastic coated food basket (removable) with a removable divider (4 available to be won in total during the Promotion Period). Total daily prize pool valued at $3,400.

Total Prize pool is valued at up to $4,998.

How the winner is determined

Weekday Prize Draws

12. There will be a total of 20 Weekday Prize Draws which will be conducted from 12.01.10 to 08.02.10 inclusive.

13. Entries for each Weekday Prize Draw will close at 11.59pm AEDST on the preceding day. Entries received on Friday, Saturday and Sunday will be placed into the next available Weekday Prize Draw on Monday. Draws to take place on the Australia Day public holiday (or any other public holiday) will be conducted on the following business day. Each Weekday Prize Draw will be conducted at 12pm AEDST at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne VIC 3207. The first valid entry randomly drawn in each Weekday Prize Draw will, subject to proof of purchase, win a Weekday Prize.

14. Individual entries received will be entered into the next available Weekday Prize Draw. Undrawn entries in each Weekday Prize Draw will be entered into any subsequent Weekday Prize Draws and all entries (including winners in Weekday Prize Draws) will be entered into the Weekly Prize Draws.

Weekly Prize Draws

15. There will be four (4) Weekly Prize Draws – to be conducted on 18.01.10, 25.01.10, 01.02.10 and 08.02.10. Entries received by 11.59pm AEDST the day before each Weekly Prize Draw will be entered into that Weekly Prize Draw. Weekly Prize Draws will be conducted at 12pm AEDST at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne VIC 3207. The first valid entry randomly drawn in each Weekly Prize Draw will, subject to proof of purchase, win a Weekly Prize.

16. Undrawn entries in each Weekly Prize Draw will be entered into any subsequent Weekly Prize Draws.

Notification of winner

17. All provisional winners will be notified by mail and where possible by telephone within two (2) days of the relevant draw.

18. All provisional winners will be required to send the Promoter a photocopy or original of their eligible IGA or Foodland purchase receipt(s) to a reply paid address for verification purposes to claim their prize. Failure to provide the proof of purchase as set out for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of that entrant’s entries.

19. The names of the Weekly Prize winners will be published in The Australian on 17.02.10. All prize winners will be published on the Promoter’s website, at www.iga.net.au.

Unclaimed Prize Draw

20. The Promoter may conduct an unclaimed prize draw at 12pm AEST on 10.05.10 at Prime Focus, Suite 104, 55 Beach Street, Port Melbourne 3207 as is necessary for any unclaimed prize, subject to any directions from a regulatory authority. Without limiting the requirement for compliance with these Conditions, all valid entries received during the Promotion Period will be eligible to win any unclaimed prize.

21. Any winner in the unclaimed prize draw will be notified by mail and where possible by telephone within two (2) days of the draw.

22. Any winner of a Weekly Prize awarded in the unclaimed prize draw will be published in The Australian on 31.05.10. All prize winners will be published on the Promoter’s website, at www.iga.net.au.

General Conditions

23. Prizes will be delivered only in Australia via mail or courier. Please allow 28 days for delivery of all prizes after the prize draw (subject to claim requirements outlined in clause 10 being met).

24. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions from a regulatory authority.

25. Prizes are not transferable or exchangeable and cannot be taken as cash. Promoter accepts no responsibility for any variation in the prize value.

26. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

27. The Promoter’s decision is final and no correspondence will be entered into.

28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

30. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

31. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; and any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in relation to the Promotion, including, but not limited to, where arising out of or in relation to the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim or other form of communication to the Promoter that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions; (e) any tax liability incurred by an entrant; or (f) use of any prize.

32. The entrant’s details will be held in accordance with the IGA Privacy Policy which can be accessed by visiting http://www.iga.net.au/igafresh/index.cfm?page_id=2335 or by calling (02) 9741 3000. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for the purpose of marketing activities such as direct marketing, publicity and generally to promote its products and services, (and includes sending electronic messages or telephoning entrants) and will also use the information for its internal administrative, planning, product development, profiling and research needs. Entrants may choose not to receive any communications from the Promoter at any time. Entrants should direct any request to access, update or correct information to the Promoter. All entries will become property of the Promoter. Each entrant’s submitted entries will remain anonymous and will be stored by the Promoter for further research purposes.

33. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

34. As a condition of accepting the prize, the winner may be required to sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
